Grandparents' Rights

In Texas, grandparents may have certain rights involving their grandchildren. In certain situations, a grandparent may even bring an original cause of action for custody of the grandchild under the Texas Family Code.  At other times, a grandparent may intervene into an existing lawsuit between the parental parties in an effort to receive regular access to the child.

As with most issues in regard to children, the law will ordinarily give a trial court broad discretion in terms of determining what is in the best interest of the child. Many times,  it is found to be in the child's best interest to maintain a familiar bond of some degree with the grandparents.
